As a result of the increase in the rates of the technical crime in a growing manner, most of countries have enacted procedural legislations that match with the nature of this crime in order to police it, to arrest its perpetrators and to collect its evidence. Nevertheless, the Egyptian legislator did not move a muscle towards these amendments in a way that has urged jurisprudence and judiciary to attempt to reinterpret the texts of current code of criminal procedure to be applied to technical crimes. In the light of the above, we showed these attempts where they were judicial applications or jurisprudential opinions. We concluded that traditional texts of code of criminal procedure can’t be applied to modern technical crimes in an absolute way due to the nature of these crimes. And there is a legislative defect that must be encountered through enacting many of the appropriate procedural texts.
